How does this law focus on Amazon?

U.S. retail giant Amazon relies heavily on thousands of workers to fill its huge warehouses, also known as distribution centers. Workers and labor organizations argue that Amazon’s rules in company distribution centers create an unsafe work environment. Tracked by algorithms, Amazon’s warehouse staff rush to pack and ship non-stop shopping orders that need to be delivered within hours.

While workers are at work, Amazon monitors their “time off task,” which the company says is monitoring “problems with the tools people use.” But it also works to identify underperforming workers. Too much free time and the algorithm signals workers.

The company has not posted a public comment on the new California law.

Other players in the retail space have done so.

A New York district court this month gave Vortic Watch Co. its latest legal victory over a division of the Swatch Group. The lawsuit, which Vortic’s co-founders have been leading since 2015, questioned the Fort Collins, Colorado-based startup’s efforts to sell recycled Hamilton-brand pocket watches as wristwatches.

Co-founder RT Custer celebrates the victory, but not for long, he says. He has bigger plans in mind: paying off the six-figure legal fees accrued by the lawsuit, as well as hiring more people at Vortic to create the watches collectors snatch up when they go on sale.

Custer and his co-founder, Tyler Wolfe, founded Vortic in 2013. At the time, Custer was a student at Penn State University in the state he grew up in. His father still lives there, virtually in the shadow of the Hamilton Watch Co. factory, Custer says. Her mother died of cancer in 2020, another reason the Swatch trial was grueling.

The idea behind Vortic was to restore and preserve old American pocket watches, carefully transforming them into wristwatches that honor the past while having the latest watchmaking craftsmanship behind the glass, Custer says.

The battle for brands began in 2015, when the world’s largest watch company heard about pocket watches from its Hamilton brand that Vortic was using in its recycling business. The Swatch Group considered this to be a trademark violation; Vortic saw it as a legal use of Hamilton parts to make a new watch.

In a September 14 opinion, a panel of federal judges from the U.S. Court of Appeals for the 2nd Circuit ruled in Vortic’s favor. The judges upheld a New York District Court ruling from September 2020 on the case on all counts.

“The court ruling reaffirms something the law has long made clear: Trademark law is not a sword to be used indiscriminately,” Jin-Ho King, one of Vortic’s attorneys, said in a statement. communicated. “There must be a risk of confusion for the consumer. Custer, who estimates the Swatch Group spent more than seven figures on legal fees on the case, says he’s not surprised by the response. “This has been their statement for six years, unfortunately.”

Custer says he researched the legal issues surrounding upcycling and his particular business idea before he and Wolfe started Vortic, and that he continued that research even while running the business. . Interestingly, according to Custer, Hamilton pocket watches only made up about 15% of Vortic’s business, and the company also uses other, larger watchmakers in its work. Yet only Swatch Group has sued Vortic.

Custer says the trial looked like those first months of the coronavirus: a huge burden. Mysterious. Anguishing. He was here, co-owner of a watch company that makes around 400 watches a year, versus a company that could make 400 watches an hour. It was overwhelming.

“For them it’s business as usual,” Custer says. “For me, it is life changing in terms of this huge unknown, and that’s why I relate it to the pandemic,” Custer said. “We didn’t know what to do. For a while, I thought I was going to lose everything… I just turned 30. [Fighting this lawsuit] has been a decade of my life.

The trial is now over, unless Swatch Group appeals to the United States Supreme Court. Custer admits that, in a way, he wants that call to happen – it would fix that problem once and for all for upcycling-style businesses. However, he really prefers to focus on his future: Vortic is currently renovating an 8,000 square foot factory and workshop in Fort Collins, Colorado; when completed, the business will open its doors to other entrepreneurs and watch fanatics. And he wants to embark on a hiring wave as soon as he pays his legal bills.

“Karma always wins,” Custer says. “We’re just getting started. “

Judith Leiber’s luxury crystal-encrusted accessories are a staple at high-end stores including Neiman Marcus, Harrods, and Saks Fifth Avenue.

Today, the brand is entering watchmaking with the help of Timex, which manufactures and distributes collections of sparkling timepieces.

The first pieces of the partnership are two limited edition watches, the T80 Digital and the Q Analog, both designed to sell out quickly with series of just 200 pieces each.

Each watch features over 900 colorful Swarovski crystals on the cases, dials and bracelets in playful combinations that fans of the distinctive designer will instantly recognize.

Judith Leiber, whose eponymous owner died in 2018 at the age of 97, was acquired by New York-based brand development and licensing specialist Authentic Brands Group in 2013.

“We are proud to strengthen our partnership with Authentic Brands Group and add a brand that is a true cultural icon in the fashion world,” said Tobias Reiss-Schmidt, CEO of Timex Group.

“We look forward to combining our expertise in luxury watchmaking with the disruptive, pop culture-inspired designs that the Judith Leiber brand is known for. “

Under the terms of the license agreement, Timex Group will be responsible for the production and worldwide distribution of Judith Leiber and Judith Leiber Couture branded watches from spring 2022 through Judith Leiber boutiques, certain authorized retailers and online.
